4.1 Eligibility

By using the Site, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all provisions herein.

Please refer to the English language as the main language of the Site.

7.1 No Warranty
THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FBA DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FBA MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED.
7.2 No Professional Advice
Any information provided on the Site is for general informational purposes only and should not be construed as legal, financial, medical, or professional advice. You should consult an appropriate professional for advice specific to your situation.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FBA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR CONTENT, EVEN IF FBA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR MAXIMUM AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
9. Indemnification
You agree to indemnify, defend, and hold harmless FBA and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (i) your breach of these Terms; (ii) your User Content; (iii) your use of the Site; or (iv) your violation of any law or third-party right.
10. Termination
FBA may, in its sole discretion, suspend or terminate your access to the Site (or any part thereof) at any time, with or without notice, for any reason, including if you violate these Terms. Upon termination, all rights granted to you under these Terms will immediately cease, and you must promptly delete any copies of Content you have downloaded from the Site.
11. Governing Law and Dispute Resolution
These Terms and any disputes arising out of or related to them, the Site, or the Services shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to conflicts of laws principles.
12. Waiver and Severability
No failure or delay by FBA in exercising any right under these Terms shall operate as a waiver of that right.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
13. Entire Agreement
These Terms, together with any documents or policies expressly incorporated by reference, constitute the entire agreement between you and FBA concerning the Site and supersede all prior or contemporaneous communications, representations, or agreements regarding the subject matter herein.
